1. Acceptance of Terms

By accessing or using the Mumbai Digital Films Academy (MDFA) website at www.mdfa.co.in (the "Site") or enrolling in any of our courses, workshops, or services (collectively, the "Services"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our Site or Services.

2. Eligibility

To use our Services, you must:

• Be at least 16 years of age
• Have the legal capacity to enter into a binding contract
• Provide accurate and complete information during registration
• Comply with all applicable laws and regulations

If you are under 16, you may only use our Services with the involvement of a parent or guardian.

3. Use of Services

MDFA grants you a limited, non-exclusive, non-transferable license to access and use our Services for educational purposes subject to these Terms.

You agree not to:

• Use the Services for any illegal purpose or in violation of any laws
• Share your account credentials with others
• Copy, reproduce, distribute, or create derivative works from our course materials without permission
• Upload or transmit viruses or any other malicious code
• Interfere with or disrupt the Services or servers
• Use the Services to harass, abuse, or harm another person

4. Course Enrollment and Payments

Enrollment Process:

Course enrollment is completed through our online application process. Submission of an application does not guarantee acceptance. MDFA reserves the right to reject any application at its discretion.

Payment Terms:

• Fees must be paid in full before course commencement unless a payment plan has been approved
• All fees are quoted in Indian Rupees (₹) unless otherwise specified
• Prices are subject to change without notice, but changes will not affect existing enrollments
• You are responsible for any taxes associated with your use of our Services

5. Intellectual Property

All content provided through our Services, including but not limited to text, graphics, logos, images, videos, course materials, and software, is the property of MDFA or its content suppliers and is protected by copyright and other intellectual property laws.

You may:

• Access and use the materials for your personal educational purposes
• Download materials specifically made available for download

You may not:

• Resell, redistribute, or share course materials with others
• Use our content for commercial purposes without explicit permission
• Remove any copyright or proprietary notices from our materials

6. User Conduct

As a user of MDFA Services, you agree to:

• Treat all students, instructors, and staff with respect
• Maintain a professional and collaborative learning environment
• Not engage in any form of harassment, discrimination, or disruptive behavior
• Use equipment and facilities responsibly and report any damages
• Adhere to all safety protocols during practical sessions

Violation of these conduct guidelines may result in immediate termination of your access to Services without refund.

7. Privacy and Data Use

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

By using our Services, you consent to the collection and use of your information as described in our Privacy Policy, including:

• Using your contact information to communicate about courses and services
• Using your image and work in promotional materials (with option to opt-out)
• Sharing necessary information with industry partners for placement purposes

8. Cancellation and Refund Policy

Cancellation by Student:

• Cancellations made 30+ days before course start: 90% refund
• Cancellations made 7-14 days before course start: 50% refund
• Cancellations made less than 7 days before course start: No refund
• Once a course has commenced, no refunds will be provided

Cancellation by MDFA:

MDFA reserves the right to cancel courses due to insufficient enrollment or unforeseen circumstances. In such cases, students will receive a full refund of any fees paid.

Refund Process:

Refund requests must be submitted in writing to admissions@mdfa.co.in. Refunds will be processed within 15 business days and issued via the original payment method.

9. Limitation of Liability

To the fullest extent permitted by law, MDFA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Services
• Any conduct or content of any third party on the Services
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Services
• Any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our Services

MDFA's total liability to you for all claims arising out of or relating to these Terms or your use of the Services shall not exceed the amount paid by you to MDFA in the six months preceding the event giving rise to the claim.

10. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us to deactivate your account.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Changes to the Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra.
